In order to access the Platform, you need to create an account under USF PRO Content Pool with legit information especially if you’re downloading Free Editorial Content from Us and meeting the requirements of our terms and conditions which specifies how to use this free content. You may not share your log in accounts to this Content Pool Platform you should kept it secret and safe. You are not permitted to share the password details with third parties to allow them to use via your decision, or otherwise. You are obliged to inform Us immediately on becoming aware of and/or suspecting a case of any unauthorized use, disclosure and / or misuse of your access.

Editorial Use Only

In short: Content that is marked with “EDITORIAL Use” may be used, edited, copied and modified by You to the extent and in such form as necessary for Your editorial use in relation of reporting and coverage of current and former events.

 

Your Rights for 'Editorial Use Only'

“Editorial Use Only” Content is granted to you subject to the following license terms:

We hereby grant you, free of charge, the following worldwide, non- exclusive, non-transferable, non-sub licensable right:

​

a) to broadcast the content over free TV, WebTV, IPTV and Mobile TV via non-encrypted terrestrial, cable, satellite, internet, mobile, wire, fiber and any other means of linear transmission to the audience; and

b) to make the Content available as Free or Ad Video on Demand on services and/or channels, by means of non-linear and non-encrypted electronic transmission to the audience upon audiences request via streaming, temporary progressive download and other non-permanent displays of the Content, excluding download to own and any other transmission for permanent storage of the Content by audiences; and

c) to edit and adapt the Content by means of technical format and encoding; and the right to edit, adapt, use and to combine the Content with other material solely to the extent and in such form as necessary for Your specific communication purpose; provided that the integrity of the Content is not compromised; and

d) to promote the Content solely for the purpose of directly announcing and promoting the exploitation of the Content to the aggregate duration of up to thirty (30) seconds; and

e) to publish and reproduce the Content an unlimited number of times in print; and

f) for written and pictured quotes of the Content.

To the extent that “Editorial Use” Content is available on the Platform, you are not permitted to make available the full duration of such Content via YouTube. You shall however be permitted to make available shortened versions of Editorial Content provided that: (i) such versions are comprised of no more than 70% of the original “Editorial Use” Content; and (ii) the credit © USF PRO CHAMPIONSHIPS is always visible in all Editorial Use Content made available by You. USF PRO CHAMPIONSHIPS reserves the right to insist on take down of any USF PRO CHAMPIONSHIPS owned or controlled Content made available by You in the instance that USF PRO CHAMPIONSHIPS believes Content is being misused. In such circumstances, the Content must be taken down by no later than twenty-four (24) hours from USF PRO CHAMPIONSHIPS’s initial take down request. The foregoing rights shall be without prejudice to any other rights or remedies available to USF PRO CHAMPIONSHIPS.

Excluded Rights

All other rights not explicitly licensed hereunder are reserved by USF PRO CHAMPIONSHIPS. The following rights are especially not granted, unless otherwise agreed on in writing:

​

a) No advertising use: You may not use Content and Services for any commercial, advertising, advertorial, endorsement, merchandising or promotional use.

b) No long-formats: You may not edit, adapt, use and combine the Content with other material to create or produce either a commercial long-format program (e.g. such as a documentary or a clip show) exceeding the total length of 12 minutes or an editorial program that does contain more than thirty (30) % of Content in total.

c) No music rights: Any and all rights regarding music (including but not limited to the sync and master use rights) are not licensed under

Editorial Use and explicitly excluded. Overall, you guarantee to clear and acquire all necessary rights to the music and its performance including such rights that are held by collecting societies prior to its usage and exploitation and shall indemnify and hold Us harmless against all claims in connection therewith.

d) No re-publication: You may not reproduce, modify, alter or otherwise exploit the Platform, Content and Services to any other computer, server, website or other medium for publication or distribution.

e) No commercial use or distribution: You may not sell, license or sublicense Content against a fee to third parties, e.g. through sub- distributors and/or sales agents in various markets and distribution channels.

f) No unlawful use: In particular, You are prohibited from using any Content in connection with: (aa) illegal products, content, services or materials; (bb) coverage of accidents, assaults, catastrophes or riots); (ii) use the Platform, Content or Services (aa) in any unlawful, threatening, racist, libelous, defamatory, invasive of privacy or publicity rights, vulgar, obscene, profane, pornographic or otherwise objectionable way, or violate any applicable law and/or (bb) for the publication of, linking to, issue or display any material, that contain any virus, trojan horse or other harmful code or script; or (iii) encourage conduct that would constitute a criminal offence, give rise to civil liability or otherwise violate any law.
